1. About these terms
1.1 These Website Terms of Use (“Terms”) govern your access to and use of ozclicks.com.au (the “Site”), operated by AIMALL PTY. LTD. (ABN 68 601 572 043) under the OZClicks brand (“OZClicks”, “we”, “us”, “our”). By accessing or using the Site you agree to these Terms. If you do not agree, please do not use the Site.
1.2 We may update these Terms from time to time; the current version is always on this page and applies to your use of the Site.
2. The Site is information only
Content on the Site is general information about us and our services. It is not an offer, quote, advice or contract, and you should not rely on it as such. Any prices or packages shown are indicative starting points only and may change.
3. Free diagnosis
A “free diagnosis” is a no-obligation conversation. It creates no contract or commitment on either side. Nothing said before a written agreement is signed is binding.
4. Engagements are governed by a separate agreement
If you engage us, the work is governed by a separate written agreement (our Software Development Services Agreement or written proposal and its Statement of Work), not by the Site or these Terms. Where they conflict about an engagement, that agreement prevails.
5. Intellectual property
All content on the Site — including text, graphics, logos, images, case studies and layout — is owned by or licensed to OZClicks and is protected by law. We grant you a limited, non-exclusive licence to view it for your own information. You must not copy, reproduce, republish or exploit any content without our prior written consent.
6. Your use of the Site
You must not: use the Site unlawfully or for any improper purpose; attempt to gain unauthorised access to, interfere with or disrupt the Site or its systems; introduce malicious code; or submit false, misleading or infringing content through any form.
7. Forms and submissions
If you submit information through the Site, you confirm it is accurate and that you are authorised to provide it. We may contact you in response. We handle personal information in accordance with our Privacy Policy.
8. Case studies and results
Case studies describe past projects. Outcomes depend on each client’s circumstances and are examples only — they are not a promise or guarantee of any particular result for you.
9. Availability
We aim to keep the Site available but do not guarantee it will be uninterrupted, secure or error-free. We may modify, suspend or discontinue any part of the Site at any time without notice.
10. Disclaimers, liability and the Australian Consumer Law
10.1 The Site is provided “as is” and “as available”. To the maximum extent permitted by law, we exclude all warranties, and we are not liable for any loss or damage (including indirect or consequential loss) arising from your use of, or inability to use, the Site or reliance on its content.
10.2 Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you may have under the Australian Consumer Law (ACL) or other law that cannot lawfully be excluded. Where our liability can be limited under the ACL, our liability is limited, at our option, to re-supplying the relevant services or paying the cost of having them re-supplied.
11. Indemnity
You agree to indemnify us against any loss or claim arising from your breach of these Terms or your misuse of the Site, except to the extent caused by us.
12. Third-party links
The Site may link to third-party websites we do not control. We are not responsible for their content, products or practices, and a link is not an endorsement.
13. Governing law and jurisdiction
These Terms are governed by the laws of New South Wales, Australia. You submit to the non-exclusive jurisdiction of the courts of that State and the Commonwealth of Australia.
14. General
If any part of these Terms is unenforceable, the rest continues to apply. Our failure to enforce a term is not a waiver of it. You may not assign your rights under these Terms without our consent. These Terms are the entire agreement between you and us about your use of the Site.
