1. Introduction
1.1 This website, ozclicks.com.au (the “Site”), is operated by AIMALL PTY. LTD. (ABN 68 601 572 043) under the OZClicks brand (“OZClicks”, “we”, “us”, “our”). We provide AI-built custom software and digital marketing services to Australian businesses.
1.2 We are committed to protecting your privacy and handling your personal information openly and in accordance with the Privacy Act 1988 (Cth) (the “Privacy Act”) and the Australian Privacy Principles (the “APPs”). This policy explains what personal information we collect, how we use and disclose it, and how you can access, correct or complain about how we handle it.
1.3 “Personal information” means information or an opinion about an identified, or reasonably identifiable, individual. By using the Site or providing information to us, you agree to your personal information being handled as set out in this policy.
2. The personal information we collect
2.1 The kinds of personal information we may collect include:
- Identity and contact details — your name, business name, email address, phone number and website;
- Enquiry and project information — details you provide about your business, current systems, needs, timeline and budget (e.g. via our diagnosis/enquiry form or during a call);
- Transaction information — records of services provided and payments (card details are handled by our third-party payment processor, not stored by us);
- Technical and usage data — IP address, device and browser type, pages viewed, referring URLs and similar analytics data collected automatically via cookies and similar technologies;
- Communications — records of your correspondence with us.
2.2 Sensitive information. We do not seek to collect sensitive information (such as health, racial or political information). If we ever need to, we will only collect it with your consent and where reasonably necessary.
3. How we collect it
3.1 We collect personal information: (a) directly from you — when you complete a form, email or call us, or engage our services; (b) automatically — through cookies and analytics when you use the Site; and (c) occasionally from third parties — for example, if someone refers you to us, or from publicly available sources. Where it is reasonable and practicable, we collect personal information directly from you.
4. Dealing with us anonymously
You may ask general questions or browse the Site anonymously or using a pseudonym. However, we usually cannot provide a diagnosis, quote or services without the contact and business information described above.
5. Why we collect, hold, use and disclose your information
We use personal information to:
- respond to your enquiry, run a diagnosis, prepare quotes and deliver our services;
- communicate with you, including confirmation, scheduling and follow-up emails;
- process payments and manage our client relationship and records;
- operate, maintain, secure and improve the Site, and measure marketing performance;
- send you information about our services (see clause 6); and
- comply with our legal obligations.
We only use and disclose personal information for the purposes for which it was collected, related purposes you would reasonably expect, or as permitted or required by law.
6. Direct marketing and the Spam Act
6.1 We may send you marketing communications about our services where you have consented or would reasonably expect it. Every marketing email contains an easy way to unsubscribe, and we will action opt-out requests promptly. We comply with the Spam Act 2003 (Cth).
6.2 You can opt out at any time by using the unsubscribe link or contacting us (clause 14).
7. Cookies, analytics and online advertising
7.1 The Site uses cookies and similar technologies to function, remember preferences, measure traffic and support advertising. We use third-party tools including Google Analytics 4 and Google Ads (including conversion tracking and remarketing). These providers may set cookies and process usage data on our behalf.
7.2 You can control or delete cookies in your browser settings, opt out of Google Analytics via the browser add-on at tools.google.com/dlpage/gaoptout, and manage personalised advertising at google.com/settings/ads. Blocking cookies may affect how the Site works.
8. Who we disclose your information to
We may disclose personal information to:
- service providers who help us operate — including website hosting, email and CRM, analytics and advertising (e.g. Google), and payment processing;
- professional advisers such as our accountants or lawyers, where reasonably necessary;
- authorities or others where required or authorised by law.
We do not sell your personal information. We require our service providers to protect it and to use it only for the purposes we engage them for.
9. Overseas disclosure
Some of our service providers (for example, Google) may store or process personal information outside Australia, including in the United States and other countries where they or their sub-processors operate. Before disclosing, we take reasonable steps to ensure the recipient handles your information consistently with the APPs.
10. Data quality
We take reasonable steps to ensure the personal information we hold is accurate, up-to-date, complete and relevant. Please let us know if your details change or are incorrect.
11. Security, storage and retention
11.1 We take reasonable steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
11.2 We keep personal information only as long as needed for the purposes above or as required by law, after which we take reasonable steps to destroy or de-identify it.
12. Data breaches
We comply with the Notifiable Data Breaches (NDB) scheme under the Privacy Act. If a data breach involving your personal information is likely to result in serious harm, we will notify you and the Office of the Australian Information Commissioner (OAIC) as required.
13. Accessing and correcting your information
13.1 You may request access to, or correction of, the personal information we hold about you by contacting us (clause 14). We will verify your identity and respond within a reasonable time (usually within 30 days).
13.2 Access is generally free, though we may charge a reasonable cost for retrieving and supplying it. If we refuse access or correction, we will explain why and how you can complain, except where the law provides otherwise.
